Green, Deputy Director of California State Parks OHV Division. Ms. Green
stopped by to give us a quick update on some of the issues OHV Division has
been working on. One of the biggest issues right now is with the asbestos
testing going on in the Clear Creek area and also in Eldorado Hills. The BLM is
considering a seasonal closure of the Clear Creek area. The Green Sticker
issue: involving the mounting of green stickers on your bikes, section 3800 of
the CA vehicle code is not easily interpreted and this is something we will be
working on clearing up. Dave Pickett has been very instrumental in working on
this issue with the various agencies involved. The State is delighted to once
again host the Hangtown MX National at Prairie City OHV Park and looks forward
to a continued relationship with promoters; Dirt Digger’s North Motorcycle
Club. Thank you Ms. Green for taking the time to stop by and update us on some

2 events held
since the last meeting: The Fools Gold Enduro on May 1st and the
Little Polecat Enduro on May 15th.
For the Fools Gold race referee was Cliff Glidden. Course was 96.9
official miles with ground miles of 78.29. The course included a common course
section run before and after the first gas available. Excellent riding
conditions, with a great section of new trail. Total riders were 278: 91 A’s,
70 B’s, and 109 C riders. One injury reported; treated by the EMT and released.
Information on the Little Polecat has not been received yet. It was said the
event went smoothly no law enforcement issues with Rangers reported. Youth Enduro: Steward

49er Family
Enduro originally scheduled for May 8th was held the following
weekend May 14th due to weather. The course was approx. 58 miles.
Total riders were 135: 98 adults and 37 youth. No injuries were reported and
same day trophies were handed out. Polka Dots did a great job, thank you for
the extra effort required to prepare for the event twice. Dirt Track: Steward

We have held 5
events: 3 Motowest, 1 event held at Hollister by Santa Clara Riders Unlimited
and 1 at Lodi Cycle Bowl by Stockton MC. 3 injuries reported: One broken arm,
one rider with chest pains who was treated and released and our former Steward
Bob Bacosa broke several ribs and punctured his lung. Bob is reported to be out
of the hospital and recovering at home. Rider count reported: 160 riders for
the May 7th event in Newman and 167 riders for the May 14th
event at Ø

reported: there were over 200 riders for the recent event that included the

Head Tax issue
has finally come to a close. Structural changes within the AMA have begun.
Attended meeting on sound issues, work on these issues has been primarily off

is present, than try to contact them by mail or phone later to get missing

possibility of adding a Family enduro, meetings are scheduled with the Ø

orders have arrived and are here for pick-up. LAO: Dave
Pickett reported: Ø Clear Creek -
As many of you know, CCMA is now closed on a seasonal basis. Asbestos concerns
have created a “dry environment” condition which creates dust, and BLM was
forced to follow ESA guidelines. Not all of staff at CCMA agrees with this
decision. #36 and BRC have a legal brief in process
and a filing to reopen the facility based on SCIENTIFIC proof, and not
environmental rhetoric are the reasons for closure. #36 wants the EPA to explain why of all 44
counties that contains these strains of asbestos, ONLY an OHV area in operation
for over 60 years was targeted. Perhaps all the other 44 counties need to be
shut down for 5 months out of the year so that all human species will not be affected
by asbestos as EPA claims.....This will effect the grants process for funding
at CCMA, as we know OHV Commissioner Spitler and the other greens WILL push for
only 7/12's of the money they ask for. Spitler hates CCMA and has shown he will
do anything to crush this important riding area. Ø OHV
Stakeholders - A few weeks back, OHV
Stakeholders met. Good and bad here. Good. Ed Waldheim, President of CORVA and an appointed OHV
Commissioner, publicly reprimanded Stakeholder Karen Schaumbach for an article
she wrote and published in the LA Times.
She lambasted OHV in this article, and called OHV EVIL people. Ed did
not take kindly to this, and basically rearranged part of her anatomy. Ed spoke
for all OHV here, and KS just kind of rolled her eyes. These types of actions
are what are called “ground rule violations” and was admonished by the State
paid facilitator, Lisa Beutler. OHV
stood up and clapped when this took place, and the environmental caucus
representatives just sat there, not knowing what to do........ Bad. OHV Program Extension was discussed. A new assembly
bill, AB555 was submitted by the southern California OHV groups by their
lobbyist, Pete Conaty. ALL OHV organizations attended, and spoke on behalf of
support for this bill at the first committee meeting. 77 folks got up and talked, made their
comments, and support of the bill. 1 person was in opposition, Virgil Welch, representing
Pacific Conservation League. (PCL) It passed out of committee with 8 Democrats
supporting it. Roger Niello spoke publicly of support on our behalf, same with
Nicole Parra. Fast forward 2 weeks, Bill went to a second committee
and died. Every anti-OHV organization lobbied hard and we lost the 5 year, no
strings attached extension. Effort to salvage the extension was discussed in
stakeholders, and it was chopped to 3.5 years, and the groups went into caucus.
otorized caucus, which LAO is a member, and LAO fought for the original time
frame, or permanent status, and argued unsuccessfully within caucus that
the environmental caucus could not be trusted. The caucus, without my
support, voted to go along with the floor discussion of 3.5 years. The floor
came back, and the environmental caucus CHANGED the extension to 2.5 years, 1
year shorter than caucus/floor discussion, and it passed. #36 abstained from
this vote, and it passed with stakeholder support overall. Motorized caucus
members pounded #36 LAO for support, which I said no, but did not break
consensus by abstention. On the
following Monday, the Environmental caucus pulled all support for any type of
consensus, and the extension of the OHV Program died. The State legislature looks to ratified support for
decision concerning OHV from the Stakeholder process, and now the extension is
dead. As stated before, the only “green” I trust is
cash..............We still have until 2007 to renew the sunset, so time remains
but is short. Interestingly enough, by
law, the OHV Commission is set to terminate on 7-1-06, under mandated
law unless reauthorized. This is 6 months before the program sunsets...... This
may not be a bad thing........... Ø COMMISSION
APPOINTMENT - OHV has supported a
gentleman named Dick Taylor to replace expired term member Hal Thomas. Thomas
is not our friend, and we were looking forward to a more balanced Commission.
This commission appointment, unfortunately, is under the control of the Senate
Rules Committee, and is chaired by Senator Perata (D) I
learned a few days ago that Dick Taylor did NOT get the appointment, and Thomas
was reappointed for another 4 years. This puts the Commission lopsided with a
4-3 stacked commission against most OHV wishes...... Ø Mammoth Bar - Mammoth Bar just lost the Castle Rock, Indian and
Chaparral trails to OHV use. Sources indicate Erosion restoration and trail too
steep for the area. But, we did obtain resurfacing to the entrance road. Great, we have a nice road to use to go
riding for only 3 days a week, assuming you have a green sticker, and not a red
one during red sticker closure months. Ø Assembly Bills
AB555 & AB1086. AB555 would have extended the OHV program for 5 years.
It has died in committee as stated above inside the Stakeholders report. AB 1086 is/was a very DANGEROUS bill to OHV. Again, a Pacific Conservation League bill
(PCL) introduced by Sally Lieber (D) was filled with very nasty stuff. Trailers
were added that were ridiculous, such as a 4" 12" metal license
plates that they wanted mounted on the front and rear of Off Road motorcycles,
rather than the traditional “green sticker” we use now. OHV user groups, including #36 and our
lobbyist Terry McHale, managed to get the bill gutted of all the crap that got
attached. The intention of the bill was to increase fines and punishment for
“voluntary” and chronic Wilderness Intrusions. Primarily aimed at the
snowmobile users, it would have affected all OHV, and includes a provision for
citations, AND records kept on children/minors until they get their drivers
licenses. #36 is fighting this tooth and nail to get the drivers license
portion removed for minors, as this may just be a “smokescreen” for OHV to have
insurance requirements while riding off road. ALL OHV groups are monitoring
this closely and fighting portions of it that are unfair, restrictive, and
basically BS to the OHV community. They never give up do they..............? Ø HANGTOWN /
SOUND TESTING SUCCESS / DIGNITARY SUCCESS The 37th Hangtown is now in the record
books. Ed Santin (#36 Congressman
and DDNMC Director of Competition) put together a “voluntary” sound test area
in the pits at Hangtown. Over 350 riders took advantage of this, and due to
Ed’s work, walked away with some very cool prizes just for getting tested. Ken and Joyce Heuser handed out the
free stuff, sold raffle tickets, memberships, etc. (By the way. For Joyce to participate [read work} at
Hangtown, she had to work 8 days straight, just to work 3 more days straight,
then go back to her regular job to work 5 more straight days. Are we straight
on this? Kudos Joyce) Also, Kudos to John
Davis (#36 Sanction Steward and “Mr. Sound Test” nameplate and John Hartvickson [yes, that John Hartvickson) for spending hours
and hours all day doing sound tests.......Saw John later, sucking up more than
his share of cold beers..............I said how are you, and he cupped his ear,
and said “WHAT???” The MX crowd
basically said the same thing; I did not realize my bike was THAT loud. Sound education continues.................. AMA Pro WAS paying attention.....6 Pro riders came
over to be tested. Most failed 1-2 db (A). By the way, if you ever go to” will call” at Hangtown,
it is nuts! I went up to assist in the layout of the Dignitary Invitations for
about 15 minutes. Didn’t leave for 6 ½ hours. Ditto on Sunday, worse! LAO has a new found “respect” for DDNMC own PAM SANTIN, who does this for

Coats for their assistance in the Dignitary Area. Good representatives for
District #36...Kept their cool in the heat...... Turn out was very good in the “Dignitary Area” with
Assemblymen Leslie, La Malfa and a special visit by Senator Rico Oller. We had
the Chief of Staff for Senate Minority Leader Dick Ackerman on board (Dan
Chick) and Dan rides a KTM....Cool. Also, State Parks Director Ruth Coleman and
family were on hand, as well as Deputy Director Daphne Greene of OHMVR
Division. Some senior level cabinets secretaries to Thank You to the Dirt Diggers for allowing #36 LAO to
use this “catalyst” as a way to get more politicians and decision makers aware
of #36, motorcycling, and the people that make our sport the best in the world...
Special thanks to our Cross Country Stewards who could NOT make it to Hangtown,
and did their duty at the Ø LAO BIKE
DEBUT! The #36 fund-raising bike, a Kawasaki KX250-F, was
brought to Hangtown for the grand debut. Hundreds of tickets were sold. The
“tricked out” bike was is the Sound Test Area and riders were able to see it.
Due to a snafu, the sound test area was dismantled, and relocated because the
area was needed for additional parking. The relocation of the bike confused
some folks, and did not realize the bike was up on Hangtown Mall, thus it hurt
ticket sales. Excitement over the bike
was evident, and I believe our goal to raise LAO funds will be
accomplished.......More to come on this. The bike is on the website now, and additional
sponsors will be indicated as they come on line. #36 goal is to have a $10,000
Retail Package for the winner..... 2nd and 3rd prizes are available

INVENTORY PROCESS The “designated” Trail Inventory mapping continues.
Some forests are done, and public hearings are starting to be announced.
Inventory Maps/ paper and CD are also starting to become available. Clubs or
individuals that know a specific area should get involved, and review the
documents so your favorite trail is not missed, and to bring attention to the
LAO or the forest, errors you find. YOUR OHV taxes are being used to fund this,
and gulp, $10,000,000 (yes, million) and we only have a limited time to
respond. Get on it everybody, and 19 individual forests are involved. LAO is
only 1 person, so need your help here. Ø OHV GRANTS
PROCESS 2005-2006 #36 LAO was the ONLY OHV representative in the 2 day
State Parks Grant School a while back. USFS, BLM, Cities. Counties, Law
Enforcement, and others attended this school held in Folsom. Many Grant writers came up to me and
expressed their appreciation that I was in attendance representing #36. OHV Division, with compliance and process as
well as Emergency Regulations, has formed a new application process for grant
submission by the BLM, USFS, Law Enforcement, and others that has changed quite
a bit. Time lines will be strictly adhered to, and no second chance exists if
late. Division is trying to streamline the process, and has expended a great
deal of effort to improve the process. If you remember, I spend huge amounts of
time (as well as my predecessor Bill Dart) on the monitoring and support, or,
lack of support - on EACH of the grants submitted. This year it is VERY ugly for OHV, as the commission
has outlined the lion’s share of 18 million to, what else........Restoration.
Over 7 million. Law Enforcement takes in the tail with a paltry 2.0 million,
and the left overs go to everything else........ Remember, the Commission is appointed by those in
power within the legislature. We know who controls the legislature, so next
time you think YOUR vote does not count, remember the sentence above. If you
are registered, VOTE. If you are not registered, do so. Where possible, get
involved in your Assembly and/or Senate district, and let them know you are an
OHV’er and you want to assist........... Ø OWL BIRD
POOP STUDY #36 AND BRC are committee members in a Mendocino Forest
Spotted Owl study. This is a scientific study relating to the nesting habits of
the owls, and relationship to the whole owl study process. This time, it is
going to be seen through........ Don “OWLMAN” Amador pulled #36 into this, thus OHV has
a chair at the table. More to come on this, and hopefully, we will be able to
put this headache to rest.......... Ø STATE PARKS
AUDIT - “Follow the money.” Every day I continue to hear rumors about the
hemorrhage of OUR money being frittered away. 6 FULL time auditors are in OHV
division headquarters every single day going over the books. The are going way, way back in time, and are scrutinizing
every single grant, process, compliance with law, transfers, expenditures, etc.
The audit process has put a severe drain on OHV Division leaderships time,
especially Deputy Director Greene, as she is called in almost daily to clarify,
advise, or supply documents to the auditors. It has been delayed again, and now
August is the new target date. This has been going on for months, and details such as
listening to hundreds of hours of OHV Commission Meeting tapes are the norm.
Senator Morrow ® convinced the Audit Committee of the Senate, that enough
information was available concerning “monkey business” that the Senate Investigation
Committee approved this audit. Audits are big bucks, and from what I have seen,
this is one from hell. #36 LAO welcomes this audit, and believe it is far
overdue. Rumors and stories have been rampant these last few years, and fraught
with questionable transfers of funds. A key one for LAO is 3 million per year
being transferred over to state parks, so they can balance their books. Huh? And
this has been going on for 3 years that I know of. 9 Million dollars buys a lot of trail maintenance,
shovels and toilet paper................ I believe when this comes out, it could be as big as
the Kevin Shelly fiasco...........We shall see...... Ø SOUND LAO attended the National sound summit in Ø ESA -
ENDANGERED SPECIES ACT Congressman Pombo is starting hearings, serious
hearings, concerning the modification of the ESA. As most know, it is
decisively restriction, and IS harming the economy with its restrictive nature.
It has stifled OHV in many areas, and is a key component to our adversaries for
the “environmental cause of the week.”
He is making effort, via the United States Congress, to get this
modified, reduced, and cleaned up. A few
nights ago, ORBA and #36 attended a function with Congressman Doolittle, and
persuaded him to support Pombo. In July, an OHV rally/hearing will take place
to get support for this project going. It is much like the State OHV Lobby day
we do here, only larger and on the federal level. #36 will be represented by
LAO, and working with Bill Dart, Washington won’t know what they are in
for...Should be very educational and informative, and we will do what we can to
let Washington know we are concerned about this restrictive issue relating to
our concerns as OHV. I feel very proud
that the President of ORBA personally called me and asked for my attendance.
Since BRC cannot be there, I am speaking on their behalf as Don Amadors
representative, and will also report back to him. The ESA affects all OHV
organizations, and the importance cannot be under emphasized. Look for a report
soon. To fund this, we may have a #36 Prairie City “Fairy Shrimp” B-B-Q
Fundraiser soon...........That is, if we can get a permit....... What you have just read is a tiny fraction of what is
really going on. Individual issues, like the expansion of Hollister Hills, and Carnegie
Cycle SVRA are in stop mode. Shasta Dam is under pressure, and issues like what
happened at the Sawmill a few months back, continue to hammer #36 LAO. Every
issue is important, and none are discounted. To protect our clubs, and our membership, is the sole
reason for the existence of LAO. I just wish we had 3 LAO folks out

Attended the Prairie City Improvement Group
eeting. The New entrance gate will be finished in time for Hangtown. Due to
rain the alternate gate for riders will not be ready for this year, once
completed this will provide a separate entrance just for riders. Ø

At the Sacramento County Republican Central
Committee meeting I was approached by Assemblyman Tim Leslie and others who
informed me that they looked forward to attending Hangtown. Ø

Extreme Motor Sports have informed me that
they are going to become AMA chartered promoters and their July 30th
event at Sacramento Raceway will be an AMA sanctioned event. Old Business: Ø

arrived for the LAO benefit raffle bike. Many extras have been added to the

funds. Second by Jamie Williams. Vote unanimous (motion passed) Sanctioning: John Davis reported: Ø A Motorcycle Club has contacted the sanctioning steward
regarding putting on Poker run and having it be an AMA District 36 sanctioned
event. They have requested that District 36 cards and LAO fees be waived. There
was discussion regarding lower fee’s due to a poker run being a special event,
but fee’s are required no exceptions. Rulebook:
Randy Patterson reported: Ø Did we receive the AMA rulebooks ordered for
officials? No, President will check into the order. Membership:
Jill Patterson reported: Ø New District 36 stickers have been ordered and should
be received by the end of the month. Ø We need to make sure that Clubs are receiving all the
sanctioning information that they need. There still seems to be a problem with
clubs knowing what to send in and where to send it. Sanctioning packets are now
available on the District website, but perhaps we should also hand out a hard
copy at the sanctioning meeting and then designate someone to follow through
before each event and make sure that the club has the paperwork and knows where
to send everything. Old Business: Ø Update on the meeting with the TMC regarding their
upcoming Cross Country event. The club gave a list of 7 concerns that they had
with the District. Many of the concerns had to do with improvements that we
have been implementing to make our series better, such as the addition of the
youth program, the beginner women’s program, and standardization of course
markings, row line-ups and start times. The club has stated their choice to not
hold the youth or beginner women’s event, and to score the event themselves
without the use of our transponder scoring system. There is no rule which
requires a club to include these races or use these services. The club has also stated a preference that
they have no need for the cross country steward or officials to attend their
event. There was much discussion by the Board on how to handle this situation.
District 36 has a responsibility to our clubs, our riders and to our series
sponsor to ensure the quality of events. (Tabled to next month) Ø Follow up on District 36 Committeeman status up for
review. (Tabled to next month) New Business: Ø Funding Request for AMA Congress in
October, 2005. Motion by the Board to fund travel expenses for Dave Pickett, Ed Santin
and Jerry Fouts to attend the AMA Congress meeting in October 2005. Vote

Dave Pickett reported on the need to list the
LAO contribution separately on event fliers, so that riders are aware that 3.00
is added to the entry fee and contributed to the LAO fund. Discussion on a rule
