MSR/Tucker Rocky - Rider Contingency

There’s still time for most of you to sign up for the 2010 Rider Contingency program - where you can get certificates and discounts worth $300 just for signing up, then earn points that turn in to $$$ when you enter the races!!!

Don’t forget - MSR/Tucker Rocky gives us thousands and thousands of dollars each year in course supplies, certificates for riders, jackets and banquet raffle prizes . . . . make sure to support them by wearing their gear and winning more $$$ when you race!!!!

Enduro and Family Enduro series riders - get your entries in by Sept. 24th, ride all the fall events and get back more point $$$ to spend at the end of the year.

Dirt Track riders - get your entries in by August 6th, ride the rest of the D36 Series DT events and get back more point $$$ to spend at the end of the year.

Cross Country B & C Series riders - get your entries in by October 8th, ride 60% of the fall events and get back more point $$$ to spend at the end of the year.

(Note 1: “get your entries in” means that Tucker Rocky/MSR must have RECEIVED your entry by that date)

(Note 2: Pay attention to all expiration dates on certificates you receive - don’t lose out on those free $$$ !!!)

Senator Cox’s update on SB 435

“Thank you for contacting my office to convey your views regarding Senate Bill 435 (Pavley), a bill that originally would have incorporated some motorcycles into California’s smog check program. I appreciate hearing from you and having the opportunity to update you on the status of this legislation.

SB 435 passed the full Senate on June 1 by a vote of 22-17. The bill subsequently passed the Assembly Transportation Committee on June 28 by a vote of 8-4 and is now awaiting a hearing in the Assembly Appropriations Committee. I voted in opposition to this bill when it came before me.

As amended by the author on June 30, the bill would now make it a crime for a person to park, use, or operate a motorcycle registered in the state that is manufactured on and after January 1, 2011 or a motorcycle, registered in the state, with aftermarket exhaust system equipment that is manufactured on or after January 1, 2011, that does not have a U.S. EPA emission label confirming that the exhaust emission systems for those motorcycles meet specified noise emissions standards.

A peace officer would be prohibited from stopping a motorcycle solely on a suspicion of a violation of this labeling requirement. A violation would be deemed a secondary, mechanical violation and a citation may be dismissed by a court with proof of correction. Nevertheless, I am still inclined to oppose the bill as amended. Current law already identifies legal noise limits and provides for enforcement and penalties for violations relating to excessive noise from motorcycles and other sources.

Below is an email from Senator Cox regarding SB 435:

Thank you for contacting my office to convey your views regarding Senate Bill 435 (Pavley), a bill that originally would have incorporated some motorcycles into California’s smog check program. I appreciate hearing from you and having the opportunity to update you on the status of this legislation.

SB 435 passed the full Senate on June 1 by a vote of 22-17. The bill subsequently passed the Assembly Transportation Committee on June 28 by a vote of 8-4 and is now awaiting a hearing in the Assembly Appropriations Committee. I voted in opposition to this bill when it came before me.

On June 10, the author significantly amended the bill, which now requires significant financial penalties for violations associated with modifying, disconnecting, or removing any smog-related devices on motorcycles. Should the bill pass the Assembly, it will have to return to the Senate for concurrence with the Assembly amendments. As amended, I am inclined to oppose the bill as written. Current law already identifies legal noise limits and provides for enforcement and penalties for violations relating to excessive noise from motorcycles and other sources.
